ROLE TYPE: Full-Time, 3-Year Fixed Contract

ROLE PURPOSE

The Legal Advisor to the RTCIPF will provide in-house legal counsel to the Royal Turks and Caicos Islands Police Force (RTCIPF), ensuring the Force’s operations and decisions are compliant with applicable laws, regulations and human rights standards. This newly established role is critical in supporting the Commissioner of Police and the Force Executive in making sound, lawful and accountable decisions in all areas of policing, governance, policy and reform.

The Legal Advisor will act as the principal source of legal advice within the Force and liaise with the Attorney General’s Chambers, the Office of the Director of Public Prosecutions and relevant oversight bodies as necessary.

KEY DUTIES AND RESPONSIBILITIES

  1. Legal Counsel and Risk Management

– Provide authoritative legal advice to the Commissioner and senior officers on a wide range of policing matters, including powers of arrest, detention, search and seizure, use of force and internal disciplinary procedures.

– Advise on legal risks associated with operational decisions, policies, reform initiatives and emerging areas such as surveillance, data protection. and public order policing

– Assist in the development and review of internal policies, standard operating procedures, and directives to ensure legal and constitutional compliance.

  1. Legislative and Policy Support

– Monitor and advise on relevant legislation, regulations and case law developments from the Turks and Caicos Islands, UK and regional jurisdictions that may impact the RTCIPF.

– Support the Commissioner in reviewing and responding to draft legislation, government policy proposals and consultation documents.

– Contribute to legislative reform initiatives related to policing, crime and criminal justice in collaboration with the Criminal Justice leads across Government.

  1. Ethics, Oversight, and Discipline

– Advise on the conduct of internal investigations and disciplinary processes, ensuring they are fair, lawful and aligned with Police Regulations, the Constitution of the Turks and Caicos Islands and international human rights standards.

– Provide legal input into the handling of complaints, misconduct allegations and whistleblower matters.

– Liaise with and support the Integrity Commission, Human Rights Commission and Complaints Commission where appropriate.

  1. Litigation and Legal Proceedings

– Support the Commissioner in managing legal proceedings involving the RTCIPF, including civil claims, judicial reviews and employment matters.

– Liaise with the Attorney General’s Chambers and external counsel on litigation strategy, settlement negotiations and legal representation.

– Assist in preparing legal submissions, affidavits, and witness statements when required.

  1. Training and Capacity Building

– Deliver or coordinate legal training for officers and staff on relevant laws, codes of conduct, constitutional rights and legal obligations.

– Promote legal awareness and good decision-making throughout the Force.

– Support the development of legal literacy and accountability at all levels of command.

QUALIFICATIONS & EXPERIENCE

– You will be a qualified Attorney at Law or Barrister, holding a Bachelor of Laws or its equivalent, Legal Profession Certificate or its equivalent, admittance or eligibility to admittance to the bar of the Turks and Caicos Islands.

– Minimum 7 years of post-qualification experience in public law, criminal law, policing law or administrative law.

– Strong understanding of police powers, criminal procedure, human rights law, and governance in a public sector context.

– Demonstrated experience advising senior officials or working within law enforcement, prosecution services, government, or oversight institutions.

– Understanding of public sector ethics and the legal framework of the Turks and Caicos Islands or other common law jurisdictions.

DESIRABLE QUALIFICATIONS

– Experience working in or advising within the region, with understanding of comparable legal and constitutional frameworks.

– Familiarity with policing codes of practice.

– Experience handling civil litigation related to police conduct or employment law.

TERMS AND CONDITIONS

This appointment will be made on a three-year fixed term contract, which can be extended on such terms and for such period as may be mutually agreed. Salary US$73,525 plus allowances. 30 days of annual leave with full pay will be granted, which must be taken during the term of employment.
